New Mexico is located with the arid Southwest where range wars have been and continue to be fought over issues of water. Regulating and administrating the beneficial use and diversion of New Mexico's precious water is the New Mexico State Engineer, appointed by the Governor.
The state engineer has regional administration offices identified as the New Mexico State Engineers Office located in Santa Fe, Albuquerque, Roswell, Farmington, Las Cruces and Deming. The vast majority of New Mexico's land area is closed to the development of new water rights less and except domestic and livestock water. With few exceptions, domestic and livestock water development is authorized with the proper application of a permit to drill issued by the state engineer. Typically, these wells are allocated an annual diversion of three (3) acre feet. An acre foot of water is the equivalent of 325,851 gallons.
All other surface and subsurface waters utilized for agricultural, commercial and municipal use are permitted uses, however, these water rights typically can only be acquired through purchase of a pre-existing water right. New Mexico's water rights are appurtenant to the land unless stated otherwise by deed. When purchasing land you should complete the transaction by recording a change of water right ownership with the deed. This documentation is essential to evidencing historical beneficial use of your water rights. Contact me for more information about water rights in New Mexico.
